Terms and Conditions
1. Sale and Purchase of Goods
By placing an order, You (“Buyer”) agree to purchase the goods described on the checkout page (“Checkout”) from Katansilk parent company, Katansilk (“Seller”). This transaction is governed by the terms and conditions outlined in this Agreement.
2. Purchase Price
The Buyer agrees to pay the specified Purchase Price for the Goods, as indicated on this website and attached hereto.
3. Payment Terms
The Buyer must settle the full Purchase Price according to the payment due date specified at Checkout. In case of non-compliance, the Seller retains the right to pursue legal remedies and request reimbursement for costs, including attorney fees, incurred for collection.
4. Delivery
Unless explicitly agreed upon in writing, delivery adheres to the Seller’s prevailing shipping policy on the shipment date. The provided delivery dates are estimates and do not guarantee exact delivery times. While the Seller strives to meet these estimates, circumstances beyond their control may lead to delays.
5. Customs, Duties, and Taxes
The recipient of the Goods is responsible for ensuring their lawful importation into the destination country. As the importer of record, the recipient must adhere to the destination country’s laws and regulations.
Orders shipped to countries outside India may be subject to import taxes, customs duties, and fees imposed by the destination country.
Presently, all shipments are dispatched as Delivery Duty Paid (DDP), absolving the recipient of any duty or tax payment upon receipt. If an exception arises, the Seller will assist in resolving the issue.
Customs procedures vary globally, which might lead to delivery delays beyond initial estimates when clearance is involved. If necessary, recipients must provide required documents (e.g., social security number, tax ID) for customs clearance.
6. Disclaimer of Warranty/Limitation of Liability
Except as expressly provided in this Agreement, the Seller disclaims all warranties and conditions regarding the quality and fitness for specific purposes of the Goods.
7. Colour Disclaimer
Product colors as seen on computer screens may slightly differ from the actual product due to variations in technology and lighting during photography.
8. Price Disclaimer
In case of a pricing error, Katansilk.com reserves the right to decline the sale of the item, while striving to ensure accurate product descriptions and pricing.
9. Force Majeure
Seller is not liable for delays or failures attributed to uncontrollable factors, including governmental actions, labor issues, disasters, material scarcity, and other unforeseeable circumstances.
10. General
Buyer cannot assign this Agreement without Seller’s consent. This Agreement takes precedence over other agreements pertaining to the Goods. Amendments require written Seller agreement. Extra terms attached to Buyer’s order are void unless endorsed by Seller in writing. If a term becomes illegal or unenforceable, other provisions remain valid. This Agreement follows the laws of Delhi, India, and in case of disputes, Buyer accepts the exclusive jurisdiction and venue of Delhi. Any objections to jurisdiction are waived.
